Terms and Conditions

These terms cover work you hire Software Refresh to do, including website builds, redesigns, reviews, and the monthly Website Care plan. If a written quote or proposal says something different for a specific project, that quote wins for that project.
Who we work with
Our services are built for local small businesses. You have to give us accurate business information, content you have the right to use, and timely feedback so we can do the work.
Quotes, payment, and scope
Project prices in a quote are for the scope written there. Extra pages, features, or redesigns after that scope is set may be billed separately. Monthly Website Care is billed in advance. If an invoice is late, we may pause work or hosting until it is current.
Your content and the finished site
You keep ownership of your logo, photos, and copy. After the project is paid in full, you own the finished website we built for you. We may show the work in our portfolio unless you ask us not to.
Fair-use policy
Website Care has three monthly plans: Starter at $49/mo, Business at $89/mo, and Growth at $149/mo. It is priced for a typical local business website: service pages, a contact or booking path, and ordinary traffic. All three plans include hosting that can be upgraded as that site grows. Fair use keeps the plan workable for you and for us.
What "routine updates" means
Starter covers hosting, SSL, backups, monitoring, security, and scaling. It does not include content edits. Business and Growth include minor updates: hours, phone numbers, photos, a short text edit, or a new service blurb. Growth also covers more substantial edits and priority support. A new custom feature, a redesign, a large content rewrite, or turning the site into a different product is extra work. We will say so and quote it before we start.
How many requests is reasonable
A handful of update requests in a month is normal. If requests start to look like a part-time developer on staff (long lists every week, same-day redesigns, or ongoing campaign production), we may batch the work, set a turnaround, or quote a higher plan. We will tell you before we change how we handle it.
Hosting that grows with the site
You pay for Website Care, not a separate hosting add-on. If your public business website needs a stronger hosting setup because real visitor traffic grew, we upgrade that environment at no additional hosting charge.
That hosting is for the subscribed website. Fair use does not cover using the plan as a file-download host, video-streaming service, bulk email platform, software sandbox, or to run apps that are not the public site. Unusual bandwidth, storage, or compute that comes from those uses, from malware, or from automated abuse may be limited, billed, or suspended.
One Website Care plan covers one website unless we agree otherwise in writing.
Support
Support is US-based and meant for questions about the site we maintain. We usually reply within one business day. It is not 24/7 emergency coverage, on-site IT, or a dedicated developer on call unless a quote says that.
Search and AI setup
Local search setup and structured data are technical foundations. We do not promise Google rankings or that an AI tool will recommend your business.
If something is outside fair use
We will explain why, offer a path (wait, reduce the request, or pay for extra scope), and will not surprise-bill work you did not approve. Repeated abuse, illegal content, or activity that puts other sites at risk can get the plan paused or ended.
Acceptable use
Do not use our services or hosted sites for illegal activity, malware, spam, or content you do not have the rights to publish. We can take a site offline if we have to protect the server or comply with the law.
Warranties and limits
We do the work with reasonable care. Websites, hosting, and third-party tools can still fail. To the extent the law allows, Software Refresh is not liable for lost profits or indirect damages, and our total liability for a claim is limited to the fees you paid us for the service at issue in the three months before the claim.
Changes
We may update these terms. The date at the top will change when we do. Continued use of the service after an update means you accept the new terms.
